Terms of Service

1. Agreement to Terms

By accessing or using Standardise ("the Service"), operated by Maxwell Technologies Pty Ltd (ABN 23 155 857 293) trading as Standardise ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Standardise is a cloud-based information security management system (ISMS) platform designed to help organisations achieve and maintain ISO 27001 certification and comply with Australian privacy and security requirements. The Service includes tools for risk management, policy documentation, compliance tracking, audit management, and related functions.

3. Account Registration

You must register for an account to use the Service. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You are responsible for safeguarding your password and for all activity under your account.

4. Subscriptions and Billing

Access to the Service requires a paid subscription. Subscription fees are billed in advance on a monthly or annual basis in Australian Dollars (AUD). All fees are non-refundable except as required by Australian Consumer Law.

We may change subscription fees upon 30 days' written notice. Continued use of the Service after a fee change constitutes acceptance of the new fees.

5. Your Data

You retain all rights to data you upload or create within the Service ("Your Data"). You grant us a limited licence to host, store, and process Your Data solely to provide the Service. We will not access, use, or share Your Data for any other purpose.

All data is stored in Australia (AWS ap-southeast-2, Sydney) and encrypted at rest using AES-256-GCM. For details, see our Privacy Policy.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
  • Attempt to gain unauthorised access to any part of the Service or its related systems.
  • Reverse engineer, decompile, or disassemble any part of the Service.
  • Share your account credentials or allow others to access your account.
  • Upload malicious code, viruses, or any other harmful content.

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. We may perform scheduled maintenance with reasonable advance notice. We are not liable for any downtime, data loss, or service interruptions beyond our reasonable control.

8. Intellectual Property

The Service, including its design, code, features, and documentation, is owned by Maxwell Technologies Pty Ltd and protected by copyright and other intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable licence to use the Service for your internal business purposes.

9. Limitation of Liability

To the maximum extent permitted by law, Maxwell Technologies Pty Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or business opportunities arising from your use of the Service.

Our total liability for any claim arising from or relating to these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Australian Consumer Law.

10. Termination

You may cancel your subscription at any time through your account settings. Upon cancellation, your access continues until the end of the current billing period. We may suspend or terminate your account for breach of these Terms with reasonable notice.

Upon termination, you may request an export of Your Data within 30 days. After 30 days, we may delete Your Data in accordance with our data retention policy.

11. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service at least 30 days before they take effect. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
